Alan J. Arville

Experience

Alan J. Arville is a principal in Ober|Kaler's Health Law Group. His practice focuses on transactional and regulatory issues for the health care industry, including mergers and acquisitions, joint ventures, affiliations, managed care contracting, fraud and abuse, Medicare Part D and 340B compliance, tax exemption and health care licensing. His clients include regional and national pharmacy chains, health care systems and long term care providers.

A substantial portion of Alan's practice involves structuring, negotiating and implementing various health care transactions, including acquisitions of national health care companies, ambulatory surgical center joint ventures, in-store health care retail clinics, and transactions between health care providers and vendors and suppliers. Alan regularly advises retail pharmacies (chain and independent pharmacies and retailers with pharmacy operations) on a diverse array of transactions and compliance issues, including Medicare Part D compliance and 340B contract pharmacy arrangements. In addition, Alan regularly advises nonprofit governing boards and board committees on tax-exemption law issues, conflicts of interest, bylaws preparation and general corporate governance.

Alan was named a Rising Star in Health Care in the 2013 edition of Washington DC Super Lawyers and was ranked one of the “Outstanding Young Healthcare Lawyers for 2008” by Nightingale’s Healthcare News. He is the author of numerous articles and is a frequent speaker on health care topics.

- Negotiated the terms and drafted contracts to implement a 340B contract pharmacy arrangement between a hospital, retail pharmacy chain and 340B technology services vendor
- Advised national pharmacy operators on the resolution of overpayment issues, implications of the Medicare Part D fraud, waste and abuse program on "downstream" entities, structuring in-store health care retail clinics, state drug return and restocking laws, and compliance policies
