E. John Steren

Experience

John co-chairs Ober|Kaler’s Litigation Group and focuses his practice on complex business litigation including antitrust, class actions, business torts, trade secrets, non-compete, and other civil litigation matters. John regularly appears as first chair on behalf of clients in federal and state courts, before arbitration panels and regulatory agencies.

John also works closely with the firm’s Antitrust and Competition and Health Law Groups representing a variety of healthcare entities and providers including hospitals and physicians in antitrust matters (counseling and litigation) including civil and government investigations and compliance with Hart-Scott-Rodino Premerger notification requirements.

John speaks regularly and has authored articles on antitrust issues impacting the health care industry.

- Obtained U.S. District Court dismissal on filed rate doctrine grounds of nationwide class action alleging damages from purported improper reporting of end-product prices used by the United States Department of Agriculture to establish federal minimum prices payable to dairy farmers. Carlin, et al. v. DairyAmerica, Inc. et al., 690 F.Supp.2d 11 (E.D. Cal. 2010), appeal pending Case No. 10-16448 (9th Cir. Oral Argument August 31, 2011)
- Obtained summary judgment for the defendant in an antitrust action challenging the legality of a radiology exclusive contract. Imaging Center, Inc. v. Western Maryland Health System, Inc., 20052 Trade Cas. (CCH) ¶ 75056, 2005 WL 3403627, (4th Cir. 2005)
- Obtained defense verdict on behalf of a hospital client accused of conspiring in violation of antitrust laws to prevent a competitor’s expansion efforts. Sisters of St. Francis, Inc. v. Morgan County, 397 F. Supp. 2d 1032 (S.D. Ind 2005)
