Kristin Cilento Carter

Experience

Kristin Cilento Carter is an associate in Ober|Kaler's Health Law Group. Kristin generally represents physicians, hospitals, pharmacies, laboratories and other health care providers. A substantial portion of her practice involves advising clients on federal and state fraud and abuse laws and regulatory compliance issues. She also provides counsel regarding regulatory and licensure issues and managed care reimbursement and Medicare/Medicaid reimbursement issues.

Kristin has extensive experience dealing with issues relating to the Maryland Health Care Decisions Act, including providing advice to physicians and other providers with respect to health care decision-making for patients based on written and oral advance directives, living wills, surrogate decision-making and court-appointed guardianship. Kristin was instrumental in the creation of the Maryland Health Care Decision Making Website, a collaborative effort by the Maryland State Attorney General’s Office and Ober|Kaler. She is active in the ongoing maintenance of the site, which provides health care professionals with the resources, references, tools, forms and guidelines for end-of-life care and other decisions in compliance with the Maryland Health Care Decisions Act.

In 2010, Kristin was named a “Maryland Rising Star” in Maryland Super Lawyers. She is a member of the board of directors of Movable Feast, an organization providing meals, groceries, educational services and nutritional counseling to homebound individuals living with HIV/AIDS.

Representative Cases
- Counsel to several hospitals that obtained a favorable reconsideration from CMS of funds wrongly denied under the Reporting Hospital Quality Data for Annual Payment Update (RHQDAPU) program, recovering over $2 million collectively for the providers
- Health care regulatory counsel to a number of clients regarding issues relating to charges to the Medicaid program
- Health care regulatory compliance counsel in connection with the acquisition of a regional long-term care pharmacy chain
