To Disclose or Not to Disclose: An Analysis of the New CMS Voluntary Self-Disclosure Protocol

Craig Holden will be among the presenters at this teleconference and webcast on self-disclosure, hosted by the American Bar Association's Center for Continuing Legal Education.

The stakes have risen for providers who discover mistakes or other problems that may violate the Stark Law to avoid being assessed crippling penalties and sanctions. Self-disclosure is encouraged as an opportunity to potentially limit exposure in such situations. While the recent CMS Voluntary Self-Referral Disclosure Protocol provides some answers for the regulated community, serious issues remain. This teleconference will provide a high level overview of this new protocol, explore the benefits and dangers facing providers in such situations, and explain steps to consider in deciding if and when to self-disclose.
