An excerpt follows: It took nearly two years, but a small laboratory has prevailed in its appeal against having its certificate under CLIA revoked for one year for sending proficiency testing samples to another lab for analysis in violation of the CLIA statute and regulations. “To my knowledge, this is the first case in which CMS’s determination that a lab violated PT referral prohibitions has been reversed,” the attorney representing the lab, Robert E.
