Ober|Kaler regularly represents clients in significant maritime litigation and arbitration cases in Maryland and elsewhere. We play a leading role in litigation arising out of major vessel casualties on the Chesapeake Bay, and we regularly handle cases involving personal injuries, cargo damage, charter party disputes, shipbuilding and ship repair disputes, maritime lien claims, pollution, and other casualty matters and commercial disputes.
We have served as lead counsel in cases establishing important precedents involving the Federal Maritime Lien Act, the Foreign Sovereign Immunities Act, the Limitation of Liability Act, and the Supplemental Rules of Procedure applicable to maritime cases. We are also experienced in insurance coverage disputes in maritime matters, and in maritime bankruptcy cases. Our lawyers have served both as advocates and panel members in arbitrations under the Rules of the Society of Maritime Arbitrators, the American Arbitration Association, JAMS, and the Maritime Arbitration Association of the United States.
On those occasions where the government alleges criminal violations of the environment, we work with Ober|Kaler's White Collar Criminal Defense Group. That Group represents corporations and individuals in investigations, grand jury proceedings, trials, and appeals arising from allegations of criminal violations of environmental laws. Because the maritime industry is heavily regulated, we frequently assist clients with internal investigations of the allegations and/or the voluntary disclosures of environmental issues to state and federal agencies.
