The firm's national health care antitrust practice spans every antitrust problem that health care providers and their customers might face, from the simplest price-fixing issue to the most complex exclusionary conduct or merger issue. The firm regularly represents its clients in antitrust investigations conducted by the U.S. Department of Justice Antitrust Division's Health Care Task Force, the Health Care Products and Services Division of the Federal Trade Commission's Bureau of Competition, and the various state attorneys general's antitrust divisions. Where necessary, the firm litigates both governmental and private antitrust actions and also spends substantial time counseling clients in methods to meet their goals with acceptable antitrust risk.
The firm's recent health care antitrust activities have involved hospital mergers, joint operating agreements, contracting networks and other forms of hospital collaboration; medical staff credentialing antitrust litigation; exclusive contracts between hospitals and physicians; exclusive contracts between providers and managed care organizations; physician practice mergers; state medical society antitrust representation; physician networks; hospital-physician group mergers; exclusionary practices by hospitals and physicians; and even the representation of both a health care consulting firm and law firm in Antitrust Division investigations of physician and hospital price-fixing activities. In addition, members of the firm's antitrust team frequently publish and speak on these and other health care antitrust issues. One member is the author of a five-volume treatise, Health Care & Antitrust Law, published by the West Group. |
