Ober|Kaler’s insurance coverage practice lawyers have broad experience in insurance coverage matters, with industry specific expertise applicable to construction, health care, and the financial services industries, among others.

Because industry knowledge is critical in the insurance coverage arena, each of our policyholder attorneys is associated with at least one other substantive practice area in which he or she has developed independent expertise and recognition. This experience allows us to work closely with our clients in a counseling capacity in connection with negotiation of and placement of insurance coverage (and related contractual agreements) for the full range of insurance products, including CGL and umbrella and excess policies; D & O, E & O, pollution, builders risk, inland marine and marine policies; and newer products such as OPPI, CPPI, Subguard, and manuscripted policies tailored to clients’ particular needs.

In the Construction Industry, Stephen Palley is a nationally recognized expert in the area of construction insurance, and the lead editor of and contributing author to the ABA Forum on the Construction Industry’s guide to Construction Insurance (to be published in the Spring of 2011), including chapters dedicated to negotiation of construction contract insurance clauses and insurance coverage available for construction delay claim.

We maintain close connections with brokers and insurance carrier representatives in both underwriting and claims roles, in domestic and foreign markets. These relationships can provide access to and assistance with placement and negotiation of needed insurance coverage on the one hand, and resolution of claims on the other. At the same time, the firm limits itself to the representation of policyholders and has an experienced and nationally recognized trial and litigation team for claims that cannot be resolved through negotiation and that must be tried.
