"Incident To" Transmittal Rescinded

In the May 15, 2008 issue of Payment Matters, we reported that on May 2, 2008, CMS issued Transmittal R87BP, a "clarification" to its "incident to" policies for physicians and non-physician practitioners (NPPs). This clarification was to be effective on June 2, 2008. On May 30, 2008, CMS contractors were notified that the Transmittal was rescinded and will not be replaced at this time. The previous incident-to policies contained in the Medicare Benefit Policy Manual, Chapter 15, § 60 remain unchanged.
