Kelly is a principal in Ober|Kaler's Litigation Group focusing on employee benefits litigation and other business and commercial disputes including trade secrets and intellectual property, contract disputes, and non-competition and related employment issues. Kelly litigates numerous employee benefits issues under the Employee Retirement Income Security Act of 1974, 29 U.S.C. § 1001 et seq. (ERISA) on behalf of self-funded health plans and qualified retirement plans of various employers including corporate employers, governmental employers, Taft-Hartley plans and Church Plans. Kelly's ERISA litigation experience covers a variety of issues including the doctrines of complete preemption and conflict preemption, benefit claim litigation, issues surrounding employer contributions, statutory violations, subrogation claims and fiduciary duty litigation. Kelly works closely with members of Ober|Kaler's Employee Benefits Group and assists in advising clients on numerous benefits-related issues, especially in the area of fiduciary liability.
