Since 1971, Len's practice focus has been the representation of hospitals, physicians and other health care providers in transactions, contracting, compliance and litigation involving federal, state and private health care programs. Knowledgeable in Medicare/Medicaid payment and fraud and abuse issues, Len’s litigation experience includes successful representation of providers before numerous U.S. District Courts and Courts of Appeal as well as the U.S. Supreme Court. He was lead counsel defending nine hospitals in a false claims suit based on Medicare/Medicaid billing for investigational medical devices following his successful challenge to the Medicare program’s policy of not covering investigational medical devices. His experience in payment issues and policies makes him uniquely qualified for the representation of providers in need of counseling to comply with health care program requirements and providers under investigation for suspected fraud.
