  Experience  

As chair of Ober|Kaler's Employment & Labor Group, Jerry defends corporate and nonprofit employers against claims and suits brought by employees, unions, and federal, state, and local government agencies related to unfair labor practices, employment discrimination, wrongful discharge, breach of employment contracts, defamation, invasion of privacy, covenants against competition and business-related torts.

He practices before federal and state courts, the National Labor Relations Board, Equal Employment Opportunity Commission, United States Department of Labor, and the United States Occupational Safety and Health Administration and their state and local counterparts.

A court approved mediator, Jerry's practice includes alternative dispute resolution and civil litigation. He represents a variety of for-profit and nonprofit entities, including manufacturers, contractors, private schools, hospitals, nursing homes, ship owners and operators, and various businesses in connection with commercial disputes as well as the defense and prosecution of tort actions, involving, for example, defamation, intentional infliction of emotional distress, invasion of privacy, misappropriation of trade secrets, and negligent supervision.

To employers developing personnel manuals, employee handbooks and grievance mechanisms, Jerry offers advice that has frequently prevented or minimized litigation. He guides employers through drug and alcohol testing programs, non-competition and trade secret agreements, employment contracts, issues involving termination-at-will, and personnel outsourcing, and represents employers in labor contract negotiations. He also counsels clients with regard to union avoidance and decertification.

Jerry is a frequent writer and lecturer on labor, employment and business litigation matters and conducts seminars for management on a variety of employment and business issues such as litigation avoidance.
