Tony is a principal in Ober|Kaler's Construction Group and represents owners, design/builders, prime contractors, and subcontractors in a variety of settings, including negotiations, mediation, arbitration, bench trials and jury trials. Tony works on construction matters throughout the United States, as well as in Europe and Africa. His recent construction-related matters include:
- Assisting in the defense of a power plant design/builder regarding pollution control systems
- Assisting in the representation of an electrical subcontractor before a federal Board of Contract Appeals on a claim relating to the construction of a federal courthouse
- Representing a fencing sub-contractor on a claim for unjustified termination
- Heading the defense of a local business in a claim by its general contractor for alleged “extra costs” relating to the construction of the company's new offices
- Representing a mechanical contractor before the Maryland Occupational and Safety Administration
- Representing a minority-owned business in a dispute with a general contractor on a state project
- Representing contractors and owners in regard to residential home construction and improvement claims
Tony is also a member of the firm's Complex Civil Litigation Group and handles intellectual property litigation involving patents, trademarks and copyrights, insurance coverage matters, commercial contract disputes and employment-related litigation. His recent civil litigation matters include:
- First chair defense of local businessmen in a complex jury trial involving claims of accounting malpractice, breach of contract and fraud
- Defense of a large consulting firm to a claim by a subcontractor relating to environmental work for the U.S. Environmental Protection Agency
- Defense of a regional charter jet airline against claims of unfair competition and the alleged breach of a non-competition agreement
Tony co-chairs the firm's Electronically Stored Information (ESI) practice unit. In this role, he advises clients on document retention policies that provide for the unique issues raised by ESI. In addition, he has extensive experience assisting clients in litigation-related ESI concerns. |
